O R D E R

The Criminal Original Petition is filed to call for the entire records pursuant to the Crime No.263 of 2019 on the file of respondent and quash the same.

2. The learned counsel for the petitioner submitted that the petitioner is not a owner of the lorry and that his wife, who is the owner of the lorry has valid permits to transport silica sand and therefore, the offences are not made out. The issue as to whether such transport has valid permit or not and the materials are transported using those permit, requires investigation. Therefore, this Court may not be justified in rendering a finding which is a subject matter for investigation. Nevertheless, if the respondent is directed to complete the investigation within a stipulated time, the ends of justice could be secured.

3. In the light of the above observations, the respondent is directed to complete the investigation as expeditiously as possible, in any event, within a period of three months from the date of receipt of a copy of this order. Accordingly, the Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed.
