This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 403 days in filing the above Criminal Revision Case against the order dated 15.03.2024 passed in Crl.M.P.No. 300 of 2022, on the file of Addl. Mahila Judge (Magistrate Level), Tiruvannamalai.
2. Mr.M.Sivaprakash, learned counsel for petitioner submitted that due to work pressure as well as due to his mother's ill-health, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of July 2025, he gave papers to him, as a result of which, there is a delay of 403 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.
3. Mr.S.Silambuselvan, learned counsel for respondents 1 and 2 appeared and raised strong objections stating that no sufficient cause assigned for the delay.
4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
