The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 380 of IPC, in Crime No.419 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the accused 1 and 2 have entered into the office of the defacto complainant and asked one of the staff to meet her employer and at the time, the accused 1 and 2 have taken away a sum of Rs.25,000/- from the office of the defacto complainant. It is the further case of the prosecution is that the petitioner had instigated the accused 1 and 2 to commit the offence.
3. The learned counsel appearing for the petitioner would submit that based on the confession of the co-accused, she has been implicated in this case. He further submitted that the petitioner is innocent and she has nothing to do with the alleged offence.
4. The learned Government Advocate(Crl. Side) appearing for the respondent submitted that the petitioner has no bad antecedents and she was also present in the scene of occurrence and at her instigation, the offence had taken place.
K.KALYANA S U NDARAM. J., rrg 5.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate, Katpadi, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. 2 5. 0 2. 2 0 1 6 rrg Crl.O.P.No. 7 8 5 of 2 0 1 6
