C.M.P.No.471 of 2017 in CMA (SR) No.94526 of 2016 R.MAHADEVAN, J.

This petition is filed by the petitioners / appellants / claimants seeking to condone the delay of 735 days in filing the above Appeal.

2. Heard both sides. The learned Standing counsel for R-2 / Insurer (contesting respondent) stated No Objection in ordering this petition, subject to the condition that the claimants may not be entitled to any interest for the default period.

3. In view of the above and having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 735 days in filing the above Appeal is condoned subject to the following conditions:- (i) The petitioners / appellants shall pay a sum of Rs.1,000/- as costs to the "Tamil Nadu State Legal Services Authority, Chennai" on or before 20.11.2019, failing which, this petition shall stand automatically dismissed without any further reference to this Court; and (ii) The petitioners / appellants are not entitled to any interest for the default period, in the event of succeeding in the Appeal.

4. This petition is ordered accordingly.
