Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order issued by the 2nd respondent in Na.Ka.No.4769/A4/2021 dated 01.10.2021 and to quash the same and consequently to approve the appointment of the petitioner in the sanctioned post of Secondary Grade Teacher in the 6th respondent school from the date of appointment on 07.02.2018, with consequential and other attendant benefits including the payment of arrears of salary from the date of appointment and other service benefits, within a time frame to be fixed by this Court.

O R D E R

Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3 and perused the records.

2. The petitioner by the present writ petition assailed the action of the respondents for not approving the appointment of the petitioner to the post of Senior Grade Teacher by considering the proposal submitted by the 6th respondent vide letter dated 04.10.2019 and 29.03.2021.

When the matter is taken up for hearing, the learned counsel for the petitioner submitted that the issue involved in the present writ petition is covered by the decision of the Division Bench of this Court in WA.No.253 of 2025 dated 29.01.2025, whereby the Division Bench of this Court in similar circumstances had directed as under :- "11. In that view of the matter, the following orders are passed in the writ appeal:

(i) that the order impugned passed by the writ Court is set aside. As a sequel for the reasons stated herein above, the order impugned before the writ Court dated 21.03.2022 also is set aside.

(ii) Resultantly, there shall be a direction to the respondents, especially the respondents 2 and 3 to reconsider the proposal submitted by the appellant School with regard to the appointment of the Secondary Grade Teacher one J.Vijayakumar with effect from 01.02.2021 and if the appointment is otherwise in order, the same shall be approved and after approval, if the respondents find that there has been excess Teacher in the appellant School, it is open to the respondents to redeploy the Teacher to be approved to any needy School immediately. However such a redeployment would no way hamper the service prospects of the Teacher concerned including the backwages with effect from the date of 3/7

appointment."

The learned counsel for the petitioner submits that since, the case of the petitioner is also similar to the issue considered by the Division Bench of this Court and as the respondents by the impugned proceedings had failed to consider the proposal sent by the 6th respondent, the 2nd and 3rd respondents being the competent authority to consider the proposal forwarded by the 6th respondent to be directed to consider the same given in terms of the order of this Court.

5. The learned Government Advocate appearing for the respondents 1 to 3 has stated no objection to this Court issuing similar direction as issued by the Division Bench in the aforementioned writ appeal.

Having regard to the aforesaid submission and taking note of the fact the Division Bench of this Court in WA.No.253 of 2025 having directed the respondents therein to reconsider the proposal submitted with regard to the appointment of Secondary Grade Teacher i.e, Sri.J.Vijayakumar, which in the facts of the present case is Smt.N.Jeyarani, this Court is of the view that the direction 4/7

contained in the order dated 29.01.2025 in WA.No.253 of 2025 is to be made applicable even to the present writ petitioner.

7. Accordingly, the impugned order passed by the 2nd respondent dated 01.10.2021 is set aside. The respondents are directed to reconsider the proposal as forwarded by the 6th respondent vide letter dated 04.10.2019 and 29.03.2021, as per the directions contained in the order in WA.No.253 of 2025 dated 29.01.2025.

8. Subject to the above observation, this writ petition is disposed of. No costs.
