WP.No.20690 of 1999:Writ Petition filed Under Article 226 of the Constitution of India directing the first respondent Corporation to appoint the Contractuals in the regular posts in the first respondent Corporation on the basis of their date of entry into service in the first respondent Corporation either through the private Contractors or the second respondent Society after preparing the seniority list and putting the same in the Corporation place or any other appropriate Writ or direction. J U D G M E N T
(Judgment of the Court was delivered by The Hon'ble Chief Justice) On hearing the learned counsel for parties and on being pointed out the order of the Hon'ble Supreme Court in Neyveli Lignite Corporation Ltd. vs. Neyveli Lignite Corporation INDCOSERVE Thozhilalar Uzhiyar Sangam, 2014 (1) SCC 704, it is quite apparent that the seniority list has been drawn for absorption and it has been observed that in case there is any grievance / objection to the management of the Corporation, the same may be examined by the Corporation.
2.In view of the aforesaid context, learned counsel for the appellant states that out of 38 appellants before the Court, 21 are already included in the seniority list and four have been made permanent. Appellants 14, 24, 25 and 31 have passed away and the lis does not survive and the remaining appellants are seeking their inclusion in the list by approaching the Corporation.
3.He, thus, submits that the appeal may be disposed of in terms aforesaid.
