Crl.O.P.No.21483 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Jerry Joseph, who was arrested and remanded to judicial custody on 18.08.2023 for the offences under Sections 341 & 394 of IPC altered into Sections 341 & 397 of IPC in Crime No.556 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is an innocent person and he is falsely implicated in a case registered in Crime No. 556 of 2023 for the offence under Section 341 & 394 of IPC altered into Sections 341 & 397 of IPC. Petitioner is in Judicial Custody from 18.08.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Additional Public Prosecutor submitted that, defacto complainant is working as a Field Collection Officer in Royal Traders, Guindy. On 18.08.2023, his manager asked him to visit the owner's house and get the money given by the owner. Accordingly, defacto complainant visited the house of the owner. Owner's son had given a sum of Rs.15 lakhs to the defacto complainant. After getting the 1/3

money, he was coming in his two wheeler through Nethaji Salai Road. At about 11.45 p.m., he was waylaid by two persons . They started attacking him and also grabbed the cash bag from him and escaped. Out of Rs.15 lakhs, only a sum of Rs.11,50,000/- was recovered. Remaining amount is not yet recovered. Investigation in this case is not yet completed.

4. Considering the nature of the allegations made against the petitioner and still a sum of Rs.3,50,000/- is not recovered and that investigation in this case is not yet completed, this Court is not inclined to grant bail to the petitioner.
