By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the second and third respondents to return the Original Certificates namely 10th Mark Sheet, 12th Mark Sheet and Transfer Certificate to the Petitioner by considering the Petitioner Representation dated 05.12.2024.
3. Heard the learned counsel for both sides and perused the materials available on record.
4. The learned counsel for the petitioner would submit that the 2/6
petitioner has joined in the course of B.Tech. (Agricultural Engineering) in the 3rd Respondent-College. Due to some medical conditions, she was not able to pursue her study and discontinued her course with effect from 31.06.2023. The learned counsel for the petitioner would further submit that now the petitioner intend to join B.Sc., Psychology in Theivanai Ammal College For Women, Villupuram District and in this connection, she required her Original Certificates, which had been submitted before the 3rd Respondent-College. Hence, she has sent a representation to the respondents 2 and 3 on 05.12.2024 and such representation is yet to be considered by them.
5. At this juncture, the learned Government Advocate appearing for the 1st respondent would submit that the respondents 2 and 3 are proper persons to consider the petitioner's representation. The learned Government Advocate would further submit that impleadment of the 1st respondent is not necessary to the present proceeding as the respondents 2 and 3 come under the direct control of Agricultural Department.
6. In such view of the submission, without going into the merits of the 3/6
writ petition, this Court deems it appropriate to direct the respondents 2 and 3 to consider the petitioner's representation dated 05.12.2024 and pass orders on it's own merits and in accordance with law, within a period of four weeks from the date of receipt of copy of this order.
7. With the above direction, the Writ Petition is disposed of. No costs. 31.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
