Writ Petition has been filed under Article 226 of Constitution of India for issuance of a Writ of Mandamus directing the 1st respondent to grant promotion to the petitioner as Grade-I, Warden on par with petitioner's junior, A.Ganesan, based on the original inclusion of petitioner's name against Sl.No.10 in the panel for promotion to the post of Grade-I, Warden for the year 2010-2011 and grant all consequential promotions based on the seniority with all attendant benefits.

The present Writ Petition has been filed for an issuance of a Writ of Mandamus directing the 1st respondent to grant promotion to the petitioner as Grade-I, Warden on par with petitioner's junior, A.Ganesan, based on the original inclusion of petitioner's name against Sl.No.10 in the panel for promotion to the post of Grade-I, Warden for the year 2010-2011 and grant all consequential promotions based on the seniority with all attendant benefits.

When the petition is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 and 2 would submit by way of the Proceedings No.20128/ES3/2023 dated 27.06.2023 that the prayer of the petitioner has been considered. The petitioner has been included in Sl.No.71(A) in the approved list of Grade I Warders fit for promotion as Chief Head Warder for the year 2011-2012 below Tr.A.Israel, Sl.No.71 and above Tr.A.Ganesan, Sl.No.72. Further, the services of the petitioner in the category of Chief Head Warder was ordered to regularize with effect from the date on which his junior joined duty as Chief Head Warder.

3. In view of the above, since the prayer of the petitioner has already been considered and that there is no objection on the side of the petitioner, this petition has become infructuous. Therefore, the present Writ Petition is hereby dismissed as infructuous. No costs.
