The 5th petitioner Mustafa Kamal died leaving behind petitioners 7 to 10 and second respondent as his legal heirs.

2. Notice sent to the second respondent M.Sidique Hussain was returned with an endorsement 'unclaimed'. Since 4 out of 5 legal heirs are already before this Court, the estate of the 5th petitioner is sufficiently represented.

3. Having satisfied with the reasons given by the petitioner for condoning the delay to set aside the abatement, this petition is allowed.
