O R D E R
The petitioner has come forward with this petition seeking a direction to the respondent to register a case pertaining to the petitioner's complaint dated 26.12.2015 in C.S.R.No.429 of 2015. 2.The learned counsel for the petitioner submitted that the property mentioned in the complaint originally belonged to one Veerapathira Chettiar, who is none other than the grand father of the petitioner. The said Veerapathira Chettiar has three sons viz., Duraisami, Kuppusamy and Muthaiah. The petitioner herein is the son of Duraisami. After the death of petitioner's father, his mother Ponnammal has leased out their properties to Mani, Chellamuthu Udayar, Muthu, Chinnaraj @ Periasamy, Ramasamy and Natarajan.
He further submitted that the said tenants had filed a suit for specific performance against the petitioner and one Kullappa Chettiar and the said suit was dismissed by the trial Court. Thereafter, the said Kullappa chettiar and his sons colluding with the above said tenants, created forged documents and attempted to alienate the properties. Therefore, the petitioner has lodged a complaint before the respondent on 26.12.2015 and C.S.R.No.429 of 2015 has https://hcservices.ecourts.gov.
also been assigned. But the respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief.
3.At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that the petitioner has already appeared before the respondent and has given statement that he would work out his remedy before the civil forum. Recording the said statement made by the petitioner, his complaint was closed.
