Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus, directing the 1st respondent to conclude the conciliation proceedings in respect of Industrial Dispute Na.Ka.No.Aa.86/2019 dated 04.02.2019 and further direct the said 1st respondent to forward the same to the Government, to pass orders with regard to the reference of the Industrial Disputes including the subsequent developments therein and further examine the violations under Section 9A and Section 33 of the Industrial Disputes Act. The parties are referred to Mediation to resolve their disputes. After negotiations, the parties arrived at a settlement and it is evident by a Joint Memo dated 23.12.2020, filed by the petitioner and the respondents 2 to 4, duly signed, with the attestation of their respective counsels.
2. The learned Senior Counsel appearing for the petitioner Mr.V.Prakash, would draw the attention of this Court to Clause (4) of the Joint Memo, wherein, certain liberties are given to the parties to work out their remedy before the Conciliation Officer.
3. Therefore, it is open to the parties to work out their remedy in accordance with the terms and conditions of the Joint Memo dated 23.12.2020.
4. The Writ Petition is disposed of in terms of the Joint Memo dated 23.12.2020. The Joint Memo filed by the petitioner and the respondents 2 to 4 is taken on file and shall form part and parcel of the order. It is open to the parties to work out their remedy in accordance with the terms and conditions of the Joint Memo. No costs. Consequently, connected miscellaneous petitions are closed.
