O R D E R

This Criminal Revision Case has been filed against the judgment and order passed by the learned II Additional District and Sessions Judge, Tiruppur in C.A.No.117 of 2016, dated 31.07.2017 dismissing the appeal and confirming the judgment and order passed by the learned Judicial Magistrate No.II, Tiruppur made in C.C.No.656 of 2012, dated 04.10.2016, convicting the petitioner for offence under Section 138 of the Negotiable Instruments Act and sentencing him to undergo six months simple Page No.1 of 4

imprisonment and to pay a fine of Rs.4,00,000/- which is equivalent to the cheque amount and in default to undergo three months simple imprisonment.

2. During the pendency of this criminal revision case the parties reached a compromise and accordingly, the petitioner paid the entire cheque amount of Rs.4,00,000/- to the respondent and the respondent has also received the same in full quit. The learned counsel for the respondent acknowledged the fact that the matter has been settled and that this Court may take the same into consideration and pass appropriate orders.

3. In the light of the above settlement between the parties, the offence is compounded and as a consequence, the judgment and order passed by both the Courts below are hereby set aside. This Criminal Revision Case is disposed of accordingly.
