PRAYER : Petition filed under Section 528 of BNSS, to Transfer the investigation of the case in Crime No. 51/2016 pending on the file of the 4th respondent/ the Inspector of Police, CCB, Tambaram to 5th respondent/ The Superintendent of Police, CB-CID, Head Quarters, Chennai and to complete the investigation consequently file a final report within a time frame fixed by this Hon'ble Court.

ORDER
This Petition has been filed to Transfer the investigation of the case in Crime No. 51/2016 pending on the file of the 4th respondent/ the Inspector of Police, CCB, Tambaram to 5th respondent/ The Superintendent of Police, CBCID, Head Quarters, Chennai and to complete the investigation consequently file a final report within a time frame fixed by this Hon'ble Court.
2. According to the petitioner, he has been impersonated and a document has been created and the property was transferred to the name of the third party. In this regard, a complaint has been registered and an FIR has been filed in Cr.No.51 of 2016. However, the investigation has not been conducted properly and the petitioner has not been examined.
3. The learned Additional Public Prosecutor appearing for the respondents submitted that the investigation has been completed and the petitioner's signature and thumb impression were obtained and sent to Forensic Department and obtained the Expert's report. Now, the final report is pending before Judicial Magistrate - I, Tambaram.
4. In such view of the matter, this Court is of the view that the investigation is in right path. In fact, the thumb impression and signature of the petitioner has also been obtained and sent for Forensic Department and obtained an Expert's report. Hence, I do not find any merit to transfer the investigation to any other agency.
5. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 19-08-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes gsk
