ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 324, 506(ii) of IPC, in Crime No.1229 of 2021 seeks anticipatory bail.
2. The case of the prosecution is that on the date of occurrence, there was a wordy quarrel between the petitioner and the defacto complainant, due to which, the petitioner abused the defacto complainant in filthy language and also assaulted him with deadly weapons and also threatened him with dire consequences. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned government Advocate (Crl. Side) would raise strong objection stating that the petitioner is a history sheeter and having two previous cases. He further submits that the this Court dismissed the petitioner's earlier anticipatory bail petition vide order dated 01.12.2021 in Crl.OP.No.22801 of 2021.
5.On considering the fact that the petitioner is a history sheeter and he is having two previous cases and there is no change of circumstances after the dismissal of the petitioner's earlier anticipatory bail petition, this Court is not inclined to grant anticipatory bail to the petitioner.
