The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406, 420 of Indian Penal Code, 1860 in Crime No.411 of 2022, seeks anticipatory bail.

The case of the prosecution as per the defacto complainant Anjali is that, one Kellan Margaret got introduced to her, stating that, she along with the petitioner are running a company in the name of M/s. LMR Group of Company. The allegation is that, they have induced the defacto complainant stating that if she deposits Rs.11,000/-, they would arrange for a loan of Rs.1 lakh in return. Believing the same, the defacto complainant had given a sum of Rs. 11,000/- to the accused persons and that they have neither returned the money nor arranged for the loan. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and false case has been registered against him. He would further submit that the petitioner is only an employee in the said group and that the main accused in this case had been enlarged on bail. Hence, he seeks for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner along with other accused promoted a company in the name of M/s. LMR Group of Company and also induced the defacto complainant stating that if she deposits Rs.11,000/-, they would arrange for a loan of Rs.1 lakh in return. Believing the same, the defacto complainant had given a sum of Rs. 11,000/- to the accused persons and that they have neither returned the money nor arranged for the loan. He would further submit that, during the course of the investigation, it has came to light that, apart from the defacto complainant, there are several other victims, who have been cheated by the petitioners. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration the submissions made by the learned Government Advocate (Crl.Side) and also considering that the investigation is pending and there are several other victims in this case, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
