PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to call for the records relating to the order in Mu.Pa.No.356 of 2023 dated 04.03.2024, issued by the 2nd respondent and quash the same as illegal and void and consequently direct the respondents to fix the guideline value of the subject lands in R.S.Nos.216/1,2 and 3 at the rate of Rs.5,02,500/- per acre. By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.
2. Challenging the order passed by the second respondent dated 04.03.2024 issuing Form-II notice to the petitioner under Section 47A of Stamp Act, the petitioner has come before this Court. 2/5

It is seen from the typed set of papers subsequent to the impugned order dated 04.03.2024, the second respondent passed final order on 21.03.2024 directing the petitioner to pay deficit stamp duty as determined by him. Aggrieved by the subsequent order, the petitioner filed an appeal before the first respondent under Section 47A(5) of Indian Stamp Act. Since the final order has already been passed by the second respondent and the same also has been challenged by the petitioner before the first respondent, this Court is not inclined to entertain this writ petition. However, the first respondent is directed to consider the appeal filed by the petitioner dated 03.05.2024 challenging the order passed by the second respondent in Mu.Pa.No.356 of 2023 dated 03.05.2024 and pass final orders on it's own merits within a period of twelve weeks from the date of receipt of copy of this order.
4. With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 14.10.2024 Index : Yes/No Speaking order:Yes/No ub 3/5
