CMP.No.21482 of 2019 in CMA (SR) No.73596 of 2017 R.MAHADEVAN, J.

This petition is filed by the petitioner / appellant / claimant seeking to condone the delay of 1174 days in filing the above Appeal.

2. Heard the learned counsel for the petitioner / appellant. Despite serving notice on the second respondent and their name printed in the cause-list, there is no representation on behalf of them.

3. In view of the said submission, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 1174 days in filing the above Appeal is condoned subject to the following conditions:- (i) The petitioner / appellant shall pay a sum of Rs.1000/- as costs to the "Tamil Nadu State Legal Services Authority, Chennai" on or before 29.11.2019 failing which this application shall stand dismissed automatically without further reference to this Court.

(ii) The petitioner / appellant / claimant is not entitled to any interest for the default period, in the event of succeeding in the Appeal.

4. This petition is ordered accordingly.
