Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the third respondent to consider and pass orders on merits by disposing the written representation made by the petitioner on 22.7.2024. For the Petitioner : Mr.C.Prakasam For the Respondent : Mr.M.Habeeb Rahman Government Advocate
ORDER
(Order of the Court was made by the Hon'ble Acting Chief Justice) Heard Mr.C.Prakasam, learned counsel for the petitioner and Mr.M.Habeeb Rahman, learned Government Advocate for the respondents. By the consent of the parties, the writ petition itself is taken up for final disposal.
2. The grievance of the petitioner is that the respondent authorities are laying bitumen road by converting two-way road into four-way road without making any arrangement for providing
drainage and sewerage facilities. In this regard, the petitioner has submitted a representation on 22.7.2024 to the respondent authorities requesting them to construct drainage and sewerage on both sides of the State Highways road. As the said representation did not evoke any response, the petitioner has filed the present writ petition.
3. Considering the narrow scope of the prayer made in the writ petition, without expressing any opinion on the merits of the matter, the writ petition is disposed of with a direction to the third respondent to consider the representation of the petitioner dated 22.7.2024 and pass appropriate orders on merits and in accordance with law. Such exercise shall be concluded by the third respondent within a period of twelve weeks from the date of receipt of a copy of this order and a copy of the order passed shall be communicated to the petitioner. There shall be no order as to costs. Consequently, W.M.P.No.29210 of 2024 is closed.
