O R D E R

This petition has been filed seeking a direction to the eighth respondent to register a case against the seventh respondent and consequently, direct the first respondent to take disciplinary proceedings against the fifth respondent herein.

2. Heard learned counsel for petitioner and learned Additional Public Prosecutor appearing on behalf of respondents 1 to 6 & 8.

3. Learned counsel for petitioner submitted that the petitioner died and sought for some time.

4. Taking into consideration the nature of relief that has been sought for in this petition, if the legal heirs of the petitioner are aggrieved by the inaction on the part of the official respondents in not registering the case, it is left open to them to approach the concerned Magistrate Court and file a petition u/s.156(3) Cr.P.C. and work out their right. 3/6

5. This petition is not maintainable, in view of the order passed by a Division Bench of this Court in G.Prabhakaran v. The Superintendent of Police, Thanjavur reported in (2018) 2 LW Crl 489. The Hon'ble Supreme Court in its latest judgment rendered by a three Judge Bench in M. Subramaniam v. S. Janaki reported in (2020) 5 CTC 464, after relying upon Sakiri Vasu Case, has categorically held that the High Court cannot issue any direction for registration of FIR. The Hon'ble Supreme Court held that the informant has to necessarily avail of the alternative remedy provided under Section 154 (3) of Cr.P.C., and Section 156 (3) of Cr.P.C. Liberty is given to the legal heirs of the petitioner to workout their remedy as per the directions issued by the Division Bench in the order referred supra.
