PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to receive the fresh application of the petitioner in Form - CCPA with prescribed fee for grant of auto rickshaw permit and consider the same on merits.

Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondent. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The grievance of the petitioner is that his application was submitted in the year 2011 along with requisite fees. That application has not yet been considered. Therefore, the petitioner seeks a direction to the respondent to receive his fresh application and consider the same.

3.The learned Special Government Pleader points out that mere submission of the application will not entitle the petitioner for the grant of an auto rickshaw permit, as the need for issuance of such permit shall be assessed by the respondent. 4.In any event, the petitioner only seeks a direction to receive his application and it goes without saying that the respondent should consider the same in accordance with law after taking into consideration the relevant aspects. https://hcservices.ecourts.gov.in/hcservices/

5.Accordingly, the writ petition is disposed of by directing the petitioner to submit a fresh application in the proper format along with a copy of this order and prescribed fee. On receipt of the same, the respondent shall consider the application on merits and in accordance with law within a period of two weeks from the date, on which, the application is presented. No costs.
