Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 5th respondent to comply the order of the 3rd respondent vide letter in Na.Ka.No.4220/2018/THOVESA dated 19.06.2019 to appoint the petitioner as a fertilizer sales women in compassionate ground.

O R D E R

The prayer sought for in this Writ Petition is to direct the 5th respondent to comply the order of the 3rd respondent vide letter in Na.Ka.No.4220/2018/THOVESA dated 19.06.2019 to appoint the petitioner as a fertilizer sales women on compassionate ground.

The case of the petitioner is that her husband was working as a Secretary (In-Charge) in Ammapalayam Primary Agricultural Cooperative Credit Society and he was died on 18.09.2015 due to his illness. After the demise of her husband, the petitioner was not in a position to run day to day life. Therefore, on 17.12.2015, the petitioner made an application to the 5th respondent and sought for suitable job under compassionate ground in accordance with her qualification. However, the 5th respondent did not consider her representation, hence, the petitioner made further representation to 2nd and 3rd respondents. Thereafter, the 3rd respondent after enquiry have given direction to the 5th respondent to send proposal for the petitioner's employment vide letter dated 06.01.2017.

3. Pending application of the petitioner, the 5th respondent has promoted one Mrs.Rani from Sales woman to Junior Assistant. After promoting the said Rani, the 5th respondent have proposed to appoint the petitioner as a Sales woman. While the petitioner's application was pending there is a vacancy in the 5th respondent society. However, the petitioner's application was refused by the 5th respondent and the same was questioned by her. Thereafter, the petitioner made a representation to the 5th respondent. However, her proposal was not proceeded for the reason beast known to the 5th respondent.

4. In the meantime, the 5th respondent promoted the said Rani from Junior Assistant to Writer and promoted one Saroja from Sales woman to fertilizer Sales woman. Objecting the same, the petitioner gave complaint before the 3rd respondent. The 3rd respondent vide order dated 19.06.2019, directed the 5th respondent to appoint the petitioner as Fertilizer Sales woman on compassionate ground and also directed the 5th respondent to de-promote the said Saroja and also suspend the said Rani. However, till date the order of the 3rd respondent was not complied by the 5th respondent. Hence the Writ Petition has been filed.

5. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the 5th respondent to comply with the order dated 19.06.2019 within a stipulated time. 2/4

Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the 5th respondent to comply with the order dated 19.06.2019, if otherwise there is no legal impediments, within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
