This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.M.Krishnamoorthy, learned counsel for appellant and Mrs.Ramya V.Rao, learned counsel for the respondents 1 to 3 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Insurance Company is on appeal, challenging the award of Rs.42,07,000/- awarded by the Tribunal in M.C.O.P.No.2152 of 2019 dated 08.01.2024.
2.Today, 13.12.2025, the officials of the Insurance Company and the respondent 1 to 3/claimants along with their respective counsels are present.
3.After deliberations, the parties have now agreed for full and final settlement of Rs.37,50,000/- with 7.5% interest as awarded by the Tribunal.
4. It is brought to the notice that the entire compensation awarded by the Tribunal has been deposited by the appellant/ Insurance Company. 5.The 1st claimant/1st respondent is permitted to withdraw her respective share of Rs.23,50,000/- with accrued interest out of the compensation awarded by this Court. The minor respondents 2 and 3 are entitled for Rs.7,00,000/- each. The share of the minor respondents 2 and 3 are directed to be deposited in the nationalised bank in the interest bearing account. Once the respondents 2 and 3 attained majority, they are permitted to withdraw their share. The excess amount deposited by the appellant, if any has to be refunded to the appellant/Insurance Company. Award is passed accordingly.
6. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. The connected miscellaneous petition, if any, is closed.
