ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. The petition, which seeks issuance of writ of mandamus for removing the alleged illegal construction at the instance of respondent No.8, we are afraid, may not be maintainable in the absence of any locus on the part of the petitioner to challenge the same.

3. Nevertheless, taking into consideration that earlier certain directions were issued and learned State counsel submits that proceedings were drawn and pending in the matter of enquiry into

the alleged illegal construction, this writ petition is closed leaving it open to the authority concerned to proceed in accordance with law. There shall be no order as to costs. Consequently connected miscellaneous petition is also closed.
