This petition has been filed to condone the delay of 124 days in filing the above C.M.A. against M.C.O.P.No.383 of 2020 on the file of the Motor Accident Claims Tribunal, Dharmapuri, Special Subordinate Judge (MACT), Dharmapuri.

2. Though the name of the appellant is printed in the cause list, no one appeared on his behalf.

3. Since the first respondent remained ex-parte before the Tribunal, notice to the first respondent has already been dispensed with.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to order this petition.

5. Accordingly this Petition is ordered.

Registry is directed to number the appeal, if it is otherwise in order. It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for the above 124 days.
