ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 7(1) & 20(2) of Cigarette and Other Tobacco Products Act 2003 r/w Section 328 of IPC, 1860, in Crime No.803 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 111 kg of banned tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is the owner of the shop, a false case been foisted against him. Hence, he prays for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor submitted that the petitioner was found in illegal possession of 111 kg of banned tobacco products. He further submitted that the investigation is at initial stage. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the investigation is still pending and the quantity of banned tobacco product is high, this Court is not inclined to grant anticipatory bail to the petitioner.
