The petitioner herein seeks bail pending investigation in Crime No.19 of 2023 on the file of the Inspector of Police, Mettupalayam Police Station, Puducherry District for the offence under Sections 294(b),323,341,506(ii) r/w.Sec.34 of IPC and in section 25(1-A) of Arms Act 1959.
2. The learned counsel for the petitioner submitted that the petitioner is innocent and he is no way connected with this occurrence. The petitioner has been falsely implicated in this case in Cr.No.19 of 2023 for the offence under Sections 294(b),323,341,506(ii) r/w.Sec.34 of IPC and in section 25(1-A) of Arms Act 1959. Thus, he seeks bail to the petitioner.
3. The learned Government Advocate (Criminal side) stated that the petitioner had been remanded on judicial custody on 11.07.2023. But, he had been originally granted bail with condition to appear before the respondent police and sign twice a day. But, he did not sign even on one occasion. Thereafter, NBW was issued against the petitioner. Meanwhile, he 1/3
had committed another offence in Crime No.61 of 2023. In the status report filed by the respondent, it is stated that 12 previous cases had been registered against the petitioner. It is also stated that, it would be difficult to secure the petitioner and therefore, he prays for dismissal of this petition.
4. Taking all the facts for consideration, this court is not inclined to grant bail. Therefore, this Criminal Original Petition stands dismissed. 06.10.2023 gvn/gd 2/3
