O R D E R
Ms.S.Pavithra, learned Standing Counsel takes notice on behalf of the respondents 1 and 2. Mr.C.S.K.Satish, learned Standing Counsel takes notice on behalf of the third respondent. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to pay interest to the petitioner for the belatedly paid Provident Fund, Service Gratuity, Leave Salary and Commutation of Pension amount at the rate of 6% 2/5
per annum for 21 months of delayed payment in the light of the judgment passed by this Court on 23.10.2024 in W.P.No.30766 of 2024.
3.The learned counsel appearing for the petitioner would submit that the petitioner retired from service on 31.05.2023, however, the retirement benefits were settled belatedly, albeit, without any interest. He would further submit that the petitioner has sent representation to the respondent on 05.07.2025, claiming interest upon the belated payment.
4.At this juncture, the learned Standing Counsel appearing for the respondents 1 and 2 would fairly submit that the respondents would pay 6% interest per annum upon belated eligible payment as per the order of this Court in similar writ petition in W.P.No.40031 of 2024, dated 06.01.2025, within a period of three weeks from the date of receipt of a copy of this order.
5.Considering the submission made by the learned Standing Counsel appearing for the respondents 1 and 2, this Court deems it appropriate to direct the respondent to pay 6% interest per annum 3/5
upon belated eligible payment of retirement benefits of the petitioner, within a period of three weeks from the date of receipt of a copy of this order.
