The Writ Petition is filed for the following relief: "directing the respondent to engage the petitioners as Office Assistants (O.A) by considering the representation made by the petitioners dated 25.06.2025".
2. The petitioners were working with the respondent board since 1993 under the category of workmen in various regional and divisional units of the respondents as field workers and rendered unblemished service. Further, from 2013 onwards the petitioners were requesting the respondent to engage them as Office Assistant (OA) in the Head Office as well as in the Regional Office of the respondent. 3/7
3. The petitioners would further submit that they have made oral communication and written representation and the respondent assured that they will consider and take favourable action for their request. However, the respondent is appointing fresh entrants as an Office Assistant bypassing their request continuously. Additionally, the respondent made several compassionate appointments as Office Assistants (OA) in the years 2022 and 2024.
4. The petitioners submits that many of them have crossed 50 years of age and are in the same post as field workers. Perse the pay scale of Office Assistants and the field workers are one and the same and their request for the post of Office Assistant is not to get any monetary benefits. Even though there are a lot of vacancies for the post of Office Assistant, the respondent Board is failing to consider and to take favourable action for their request. In this regard the petitioners have sent their representation dated 25.06.2025 to the respondent. However the said representation has not been considered till date. 4/7
Therefore, the Writ Petition is filed.
5. Heard the learned counsels on the either side and perused the records.
6. Considering the fact that the representation of the petitioners dated 25.06.2025 has not been considered to date, the Writ Petition is allowed. The respondent is directed to consider the representation of the petitioners and pass orders on merits within a period of two months from the date of receipt of a copy of this order.
