ORDER
The instant application had been taken out by the learned counsel for the plaintiff in the suit seeking to record respondent 1 and 3 as legal heirs of the deceased second respondent.
2. The learned counsel for the applicant submitted that the second respondent died as a spinster.
3. The learned counsel for the respondents/ defendants would submit that she has no
objection in allowing the application as prayed for. However, she would point out that in the prayer, the respondents 1 & 2 in the application are sought to be recorded as legal heirs of the second defendant. She would submit that it should be respondents 1 & 3 in the application are sought to be recorded as legal heirs of the second defendant.
4. The learned counsel appearing for the applicant/ plaintiff would submit that inadvertently an error had crept in the application as well as in the Judges summons.
5. I have considered the submissions made by the learned counsels appearing on either side and perused the materials available on record.
6. In view of the admitted position, this Court is of the view that the defendants 1 & 3 in the suit can be recorded as legal heirs of the deceased second defendant. In fine, the application is allowed by recording the defendants 1 & 3 as legal heirs of the deceased second respondent. 31-07-2025 Gba To
