Dr.T.Seenivasan, learned Special Government Pleader takes notice on behalf of the respondents 1 and 2. Mr.D.Ferdinand, learned Standing Counsel takes notice on behalf of the third respondent. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to extend the benefits of G.O.(2D) No.64 Municipal Administration and Water Supplies (MC-3) Department dated 08.08.2019 and G.O.(2D) No.68 Municipal Administration and Water Supplies (MC-3) Department dated 27.08.2019 and in the light of the Division Bench Judgement in W.A. No.1615 of 2018 dated 23.11.2023 by regularising the services of the 2/5
petitioner on completion of 3 years of service from the date of her original appointment with all consequential service and monetary benefits, within a time frame.
3.The learned counsel appearing for the petitioner would submit that the petitioner has sent representation on 30.12.2024 claiming regularisation.
4.At this juncture, the learned Special Government Pleader would invite the attention of this Court about the order passed during January, 2025 in e/f/vz; 475-2025-,1(nk) by and in which representation of the petitioner was considered and rejected. Therefore, the learned Special Government Pleader would submit that the present writ petition is not maintainable. 5.However, the learned counsel appearing for the petitioner would submit that the above order was passed by the Assistant Commissioner, whereas, the competent Authority to pass the order is only Commissioner. Hence he prayed to issue direction to the respondents.

6.As rightly contended by the the learned counsel appearing for the petitioner, the petitioner sent representation only to the third respondent. The order passed by the Assistant Commissioner cannot be construed as the order of the third respondent. 7.In view of the same, without going into the merits of the writ petition, this Court deems it appropriate to direct the third respondent to consider the petitioner's representation dated 30.12.2024 upon its own merits and in accordance with law and pass orders, within a period of twelve weeks from the date of receipt of a copy of this order. 8.The writ petition is disposed of.
