ORDER
This Petition has been filed to transfer the investigation in Crime No.150/2025, from the Respondent Police to some other agency such as CBI for doing proper investigation in the said FIR.
2. According to the petitioner, the accused had assaulted her husband on 23.04.2025, as a result, he suffered head injury and was admitted in hospital as inpatient from 07.05.2025 to 22.05.2025. However, only bailable offence has been filed in FIR.
3. I perused the materials on record. FIR has been filed only under Section 115(2) of BNSS. Though the FIR was registered on 10.05.2025, no progress has been shown.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the respondent has collected the materials and will complete the investigation shortly.
5. However, the allegations with regard to the assault of the petitioner's husband which has been captured in CC TV has not been investigated. In such view of the matter, this Court is of the view that if the investigation is conducted by the same Investigation Officer, there may not be proper investigation. Hence, I direct the Assistant Commissioner of Sembium to conduct the investigation in
this matter and go through the medical records and CC TV footage and file a final report expeditiously.
