Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus to direct the first respondent to issue separate patta to the petitioner in respect of her 63 1⁄2 cents of lands in S.No.94/5 and 94/7, Therkavinashipalayam Village, covered under Document No.3266/90 on the file of SRO Palladam, Tirupur Taluk, Tirupur District, on the basis of the petitioner representation dated 03.02.2017 with the held of the respondents 2 and 3.

ORDER

The petitioner, claiming to be the owner of land covered in Survey Nos.94/5 and 94/7, Therkavinashipalayam Village, stated that the petitioner and one Mr.Balasubramanian have been separately enjoying the lands covered in the above said survey numbers, however, only the petitioner alone is unable to get separate patta. Therefore, the petitioner has made a representation dated 03.02.2017 requesting the Revenue Authorities to issue separate patta in respect of the above said property, but, till date, the respondents 1 to 3 have not considered the same. Hence, she has filed the present writ petition seeking a direction to the first respondent / the Tahsildar, Tiruppur, to issue a separate patta in her favour.

2. Mr.V.Shanmugasundar, learned Special Government Pleader appearing for the respondents 1 to 3 submitted that if a direction is given, the Revenue Authorities would pass orders on the pending representation dated 03.02.2017 of the petitioner on merits within a period of six weeks.

3. Recording the above said submission, the writ petition is disposed of with a direction to the first respondent to pass orders on the pending representation dated 03.02.2017 of the petitioner on merits and in accordance with law, after providing an opportunity of personal hearing to all the aggrieved parties including the respondents 4 to 6, within a period of six weeks from the date of receipt of a copy of this order. No Costs.
