ORDER : The Court Made the following order :- The petitioner who was arrested by the respondent police on 23.06.2021 for an offence under Sections 147, 148, 294(b), 448, and 307 IPC in P.R.C.NO.27 of 2019 on the file of the Judicial Magistrate No.1, Nagapattinam, in Cr.No.188 of 2018, seeks bail.

2. It is the case of the prosecution that when the case is pending at trial stage, the petitioner did not appear before the Trial Court for hearings and therefore, the trial Court had issued NBW against the petitioner dated 14.10.2019 and the petitioner was arrested on 23.06.2021 and remanded to judicial custody.

3. It is seen from records that this is the third bail petition filed by the petitioner. The previous order, dismissing the Criminal Original petition in Crl.O.P.Nos.19123 and 22905 of 2021 were passed by this Court on 08.10.2021 and 01.12.2021.

4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioners.

In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the third bail petition .
