ORDER

There is no representation for the Revision petitioner/Accused.

2. The Respondent / complainant filed an affidavit, dated 17.04.2024, stating that the matter has already been settled between him and the revision petitioner / accused and that he has received the entire cheque amount.

3. In the circumstances, (i) the Criminal Revision Case is Allowed.

(ii) the Judgment and orders dated 10.07.2019 passed in C.A.No.560/2018 by the learned I Additional District & Sessions Judge, Coimbatore and the Judgment and orders dated 27.11.2018 passed in C.C.No.42/2018 by the learned Judicial Magistrate, Sulur, Coimbatore, are set aside.

(iii) The accused is acquitted from the offence punishable under Section 138 of the Negotiable Instruments Act. Bail bonds, if any, shall stand cancelled. Fine amount, if already paid, shall be refunded. 22.04.2024 Index: Yes/No Speaking/Non-Speaking order vum
