By consent, the writ petition is taken up for final disposal at the admission stage itself.
The instant writ petition has been filed to direct the respondents 2 and 3 to review the suspension order passed by the 3rd respondent in Rc. No. 62/B2 / 2025 dated 03.01.2025, in the light of the G.O (Ms) No 81 issued by the Human Resources Management (N) Department dated 04.08.2022 and to reinstate the petitioner in the post of Inspector of Schools, by considering the representation submitted by the petitioner dated 30.06.2025 with all consequential and other attendant benefits, including payment of arrears of salary.
The case of the petitioner is that, he was working as Deputy Inspector of Schools, Thiruvannamalai. While so, the 3rd respondent vide order dated 03.01.2025 in proceedings RC.No.62/B2/2025, placed the
petitioner under suspension with effect from 03.01.2025, for the alleged charge of corrupt practice. The main grievance of the petitioner is that, since 03.01.2025, the respondents did not review his suspension. His further grievance is that, even subsistence allowance was not paid to him. Therefore, aggrieved by which, he submitted a representation to the 1st respondent dated 30.06.2025 and the same is yet to be considered. Hence the petition. At this juncture, the learned Special Government Pleader appearing for the respondents would submit that, the respondents are contemplating to issue charge memorandum against the petitioner and they will conclude the disciplinary proceedings within a reasonable time. 5.
In view of the above submission of the learned Special Government Pleader, without going into the merits of the matter, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 30.06.2025 and pass orders according to its own merits and in accordance with law. As far as the disciplinary proceedings is concerned, the respondents are directed to complete the disciplinary proceedings initiated against the petitioner within a period of four (4) months from the date of receipt of a copy of this order in accordance with law. If
there is any due with regard to subsistence allowance, the respondents are directed to pay the subsistence allowance to the petitioner, according to his eligibility within the above said period.
