The Criminal Original Petition has been filed seeking a direction to the learned Chief Metropolitan Magistrate (CCB & CBCID), Egmore, Chennai, to conclude the trial in C.C.No.16111 of 2008 within the stipulated time.

The contention of the learned counsel appearing for the petitioner is that based on the complaint lodged by the de facto complainant, a case in Crime No.28 of 2008 was registered by the respondent against the petitioner and others. After completion of investigation, a charge sheet was filed and taken cognizance in the year 2008 in C.C.No.16111 of 2008 on the file of the Chief Metropolitan Magistrate (CCB & CBCID), Egmore, Chennai. However, despite the lapse of time, there has been no progress in the trial. Now, the petitioner, who is arrayed as second accused in this case is aged about 78 years, hence, the present petition has been filed seeking a direction to expedite the trial.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

Considering the facts and circumstances of the case particularly that the case pertains to the year 2008 and despite the filing of the charge sheet in the year 2008, the trial is still pending, the learned Chief Metropolitan Magistrate (CCB & CBCID), Egmore, Chennai, is directed to complete the trial in C.C.No.16111 of 2008 as expeditiously as possible. 2/4
