This sub application has been filed by the applicant / son of the writ petitioner seeking leave to file the above contempt petition for the alleged disobedience of the order of this court dated 01.11.2021 passed in W.P.No.23673 of 2021.

2. The learned counsel for the applicant submitted that this court by order dated 01.11.2021 has disposed of the aforesaid writ petition, directing the respondent authorities to permit the writ petitioner to switch over to captive consumption / group captive consumption / third party sale, as the case may be and to settle the dues to him, as per their invoices along with interest as per clause 6(b). While so, the writ petitioner died on 08.10.2022. Upon several representations, the 2nd respondent vide proceedings dated 10.04.2023, allowed the utility change from EPA to EWA. However, outstanding payments have not been settled, till date and the inaction on the part of the respondent authorities put the applicant herein into great hardship and financial loss. Therefore, the applicant being the son of the deceased writ petitioner, preferred the contempt petition along with this application, seeking leave for the same.

3. Considering the reasons stated in the affidavit filed in support of this application and being satisfied with the same, this Court is inclined to grant leave to the applicant to file this contempt petition. Accordingly, this sub application is ordered as prayed for.
