This Criminal Original Petition is filed to direct the 2nd Respondent Police to register FIR on the complaint made by the Petitioner, dated 26.04.2022 in accordance with law and file final report within a stipulated time.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents.
3. The learned counsel for the petitioner would submit that he had given a complaint against one Kalpana by alleging that she had committed an offence of forgery and cheating. It is the grievance of the petitioner that despite he produced all sufficient materials, the 2nd respondent Police did not register the case and keeps the enquiry pending.
4. The learned Government Advocate Prosecutor would submit that the complaint given by the petitioner relates to the election motion and the election made therein would only attract the attention of the Election Commission.
5. Though the contention raised by the learned Government Advocate 2/4
(Crl. Side) might be right, it is to be noted that not even a C.S.R number is given for the complaint given by the petitioner and so far no enquiry has been conducted. Whatever may be the nature of complaint, the 2nd respondent is expected to give a report / closure report by making proper enquiry. Hence, the 2nd respondent is directed to assign a CSR number and complete the preliminary enquiry and do the needful in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
6. With the above direction, this Criminal Original Petition stands disposed of.
