O R D E R

The Writ Petition has been filed to direct the second respondent to implement the award passed by the learned Presiding Officer, Labour Court, Hosur, in I.D.No.96 of 2019 dated 29.04.2022. 2.

Heard Mr.K.Thiruvengadam, learned counsel for the petitioner, Mr.P.Ganesan, learned Government Advocate for the first respondent, Mr.C.Sathish, learned Government Advocate for the second respondent and perused the materials available on record.

In an industrial dispute raised by the petitioner, an award has been passed in his favour by granting the relief of reinstatement with continuity of service and all other attendant benefits. The petitioner challenged the order of termination dated 21.08.2015 as illegal and the same was accepted by the Labour Court and on that finding, the relief sought by the petitioner has been granted. The award has been passed on 29.04.2022 and so far, no appeal appears to have been filed. The petitioner gave a representation to implement the award and that also did not invoke any reply from the side of the respondents. When an award has been passed, it cannot be kept pending without compliance for months together. 2/4

In view of the above stated reasons, this Writ Petition is allowed, by directing the second respondent to consider the representation of the petitioner dated 01.08.2022 and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. No costs.
