ORDER
This writ petition has been filed by the petitioner seeking to direct the respondent herein to return the original Rectification deed dated 12.01.2015 registered as Doc.No.402 of 2015 on the file of the Respondent herein. 2.Mr.Abishek Murthy, learned Government Advocate, takes notice on behalf of the respondent. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that since the survey number and the extent of the property comprised in Survey No.8/3 measuring to an extent of 75 cents was wrongly mentioned as Survey No.9/2 measuring to an extent of 78 cents in the sale deed dated 09.03.1995 and the same was identified by the petitioner's vendor who proposed to sell the land to the petitioner, the Rectification Deed dated 12.01.2015 was registered as Doc.No.402 of 2015 on
the file of the respondent and the error was also rectified by paying necessary stamp duty and registration charges. On the very same day, the land was also sold to the petitioner through sale deed dated 12.01.2015. He would further submit that the respondent returned the sale deed dated 12.01.2015 registered as Doc.No.403 of 2015 and did not return the Rectification Deed dated 12.01.2015 registered as Doc.No.402 of 2015 to the petitioner. Despite approaching the respondent in person on several occasion requesting to return the original Rectification Deed dated 12.01.2015 and through a representation dated dated 30.07.2025, the respondent failed to return the same. Hence, the present writ petition has been filed.
4.Learned Government Advocate appearing for the respondent would submit that the representation of the petitioner dated 30.07.2025 will be considered and disposed of within a period of four weeks. 5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondent.
6.Considering the submission made by both the parties and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the respondent to consider the representation of the petitioner dated 30.07.2025 and dispose of the same within a period of four weeks from the date of receipt of a copy of this order. 7.With the above directions, this writ petition is disposed of.
