This Petition has been filed to condone the delay of 153 days in filing the above appeal.
2.With regard to delay, counter is filed by the respondent.
3. Certain points related to the merits of the case has been discussed.
4. It is stated in the counter, taking note of the condition that the appellant is the E.S.I Institution and since administrative delay has been pleaded, I am inclined to allow this petition.
5.The points raised in the counter with regard to the quantum that has to be assessed is left open to be agitated in the main case.
6.Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 153 days is condoned.
7. Accordingly,C.M.P.No.19426 of 2022 is ordered.
8.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.
