Respondents Petition filed under Article 226 of the Constitution of India to issue a Writ of Declaration declaring that the action of the respondents in returning/rejecting the petitioner claim for reimbursement on the ground of delay as per letter No.57995/pay/99-1 dated 10.10.99 as illegal arbitrary unjust and unreasonable and consequently direct the respondents to pay her a sum of Rs.1,00,000/- towards medical reimbursement together with interest at the rate of 12% per annum award costs. ORDER

Petitioner has made an application claiming the medical benefits before the respondents and the same has been rejected on the ground that the said application was filed beyond 60 days from the date of discharge from the hospital. Challenging the said rejection, the present writ petition has been filed.

2. When the writ petition was taken up for hearing Mr.Ajoy Khose, learned counsel appearing for the petitioner had produced a letter received by him from his client wherein, it is stated that the petitioner had received the medical reimbursement amount due from the government.

3. In view of the above, since nothing survives for further adjudication in this writ petition, this writ petition is closed. No costs. The letter sent by the petitioner to his counsel is taken on record.

Consequently, connected miscellaneous petition is closed.
