PRAYER: The Second Appeal filed under Section 100 of the Civil Procedure Code against the Judgment and Decree, dated 18.01.2017 in A.S.No.2 of 2016 on the file of the learned Principal District Judge, Namakkal, against the Judgment and Decree, dated 15.09.2010 in O.S.No.187 of 2010 on the file of the learned Subordinate Judge, Namakkal.

J U D G M E N T

The defendant in O.S.No.187 of 2010 on the file of Subordinate Court, Namakkal having suffered a decree for specific performance concurrently at the hands of the Courts below, has come up with this second appeal.

2. Today, the learned counsel for the appellant filed a memo wherein it has been stated that since the sole appellant died, the learned counsel sent a letter dated 20.09.2021 to the residence of the appellant for taking steps to bring on record the legal representatives of the deceased sole appellant, but, the same was returned with an endorsement 'deceased'. https://hcservices.ecourts.gov.in/hcservices/

3. Therefore, the learned counsel for the appellant expresses his inability to take steps, as there is no instruction from the legal heirs of the appellant. Hence, the second appeal is dismissed as having abated. Consequently, connected miscellaneous petition is closed. No costs.
