O R D E R

This contempt petition has been filed to punish the respondent for having willfully disobeyed the order passed by this Court on 03.02.2025 in W.P.No.27090 of 2021.

2. This Court, by order dated 03.02.2025 in W.P.No.27090 of 2021, passed the following order:

"8.......... I am therefore of the view that the impugned order cannot be sustained and hence the same is set aside. The matter is remitted to the first respondent for fresh consideration. It is needless to state that the first respondent while considering the matter afresh, will consider the explanation of the petitioner to the Enquiry Officer's report, apply his mind independently to the materials placed before him and thereafter pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order."

3. The learned counsel appearing for the petitioner submits that the 1st 2/5

respondent has passed an order on 08.07.2025, which is in violation of the directions issued by this Court, inasmuch as the respondent has merely reiterated the earlier order that had already been quashed.

4. The learned Additional Advocate General, appearing for the respondents has filed a counter affidavit wherein it is stated that, during the pendency of the contempt petition, the petitioner challenged the final order dated 08.07.2025, by filing W.P.No.41316 of 2025. The said writ petition was dismissed by this Court on 30.10.2025, on the ground of availability of an alternative remedy. It is further submitted that the petitioner preferred a statutory appeal against the final order in Proceedings No.785/2024A3/316951/2025 dated 08.07.2025, before the Appellate Authority, namely, the Secretary to the Government, Social Welfare and Women Empowerment Department, on 10.11.2025 and the same is pending consideration.

5. In view of the subsequent developments and considering that the order dated 08.07.2025 is under challenge before the Statutory Appellate 3/5

Authority, this Court is not inclined to entertain the present contempt petition.
