Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st to 4th respondents to remove the encroachment made in the water channel (odai) which is situated in S.No.52/5 at Kappalambadi Village and Post, Melmalaiyanur Taluk, Villupuram District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) On the allegation of inaction on the part of the official respondents towards removal of encroachment on water channel, learned State counsel would submit that after issuance of notice under Section 131 of the Tamil Nadu Panchayats Act, 1994, when

encroachments were not removed, notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 has now been issued on 08.08.2025 by the concerned Tahsildar.

2. In view of the above, it cannot be said that the respondents are guilty of inaction. Petition, at this stage, is disposed. There shall be no order as to costs.
