O R D E R

This Criminal Original Petition has been filed seeking to transfer the investigation in Crime No.308 of 2025, pending on the file of the 2nd respondent and to transfer the same to the file of the 3rd respondent to investigate and file a final report within the time stipulated by this Hon'ble Court.

2. It is the grievance of the petitioner that, though her husband was brutally assaulted by third parties, namely Subramani, Vijayan, Raja and Senthil, a complaint was lodged on 01.07.2025 before the 2nd respondent Police. However, the Inspector of Police, Mrs.Suguna, failed to register any case and instead attempted to settle the issue by supporting the accused. The petitioner further stated that on 05.07.2025, the petitioner and her husband were illegally detained at the Police Station and threatened to withdraw the complaint. Unable to bear the humiliation and harassment, her husband deeply distressed over the inaction of the police, set himself ablaze on 06.07.2025 and passed away on 12.07.2025. Thereafter, the 2nd respondent belatedly registered case in Crime Nos.301 and 308 of 2025 under Section 194 of the BNSS, 2023, based on a complaint from petitioner's brother-in2/5

law.

3. The learned Additional Public Prosecutor (Crl.Side), on instructions, would submit that the investigation has since been transferred to the Deputy Superintendent of Police, Nannilam, by proceedings dated 22.07.2025.

4. Heard the learned Additional Public Prosecutor (Criminal Side) appearing for the respondents.

In view of the above, this Court finds that no further necessity to transfer the investigation once again. The Deputy Superintendent of Police, Nannilam, shall conduct the investigation in a fair and fair manner and file a report as expeditiously as possible.
