..Respondent(s) Prayer:- Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue Writ of Mandamus or any other order or direction in the nature of appropriate writ directing the 1st respondent to cancel the order in Na.Ka.A3/3481/2021 dated 14.02.2022 by implementing the Mediation settlement / compromise between the petitioners dated 11.01.2024 and accepted by this Court in W.P No.34753 of 2023 dated 22.01.2024 and thereby direct the 1st respondent to intimate the 2nd respondent on the cancellation of the order dated 14.02.2022.

ORDER

The Writ Petition is filed for a Mandamus directing the first respondent to cancel the order in Na.Ka.No.A3/3481/2021 dated 14.02.2022 by implementing the mediation settlement agreement between the parties dated 11.01.2024 and recorded by this Court.

2.Upon perusing the mediated settlement agreement, it can be seen that the son has agreed to pay the maintenance upon which the father has agreed to the order by which the settlement deed was cancelled has to go and the settlement has to revive and the settlement seems recorded by this Court in the earlier proceedings.

3.In that view of the matter, this Writ Petition is allowed on the following terms:- i)The order dated 14.02.2022 bearing Na.Ka.No.A3/3481/2021 cancelling the settlement is no longer in force in view of the mediated settlement agreement between the parties.

ii)If any entry has been made by the concerned Sub Registrar cancelling the document, the said entry can be cancelled and it will be deemed that the registration of the settlement deed is in vogue and is in force and the second

petitioner Murugan son of Thangarasu will be the owner of the property as per the settlement deed.

iii)No costs.
