The petitioner, who is sole accused, was arrested and remanded to judicial custody on 15.03.2016 for the alleged offences punishable under sections 354(A)A, 376 and 511 IPC, in Crime No. 2 of 2016 on the file of the respondent police and hence, seeks bail.

2. According to the de-facto complainant, she is a servant maid under the accused and on 14.05.2015 at 10 a.m., the accused misbehaved with the de-facto complainant and also had physical relationship against her wishes.

3. The learned counsel appearing for the petitioner submitted that the petitioner is a Priest in a Church at Namakkal and with regard to administration of the Church, a suit in O.S.No. 81 of 2016 is pending before the learned District Munsif Court, Namakkal and the present complaint was given at the instigation of the opposite parties. It is further submitted that the occurrence said to have taken place on 14.05.2015, but the present complaint was preferred only on 18.02.2016, after lapse of 7 months.

4. The learned Government Advocate (Criminal side) appearing for the respondent vehemently opposed the bail petition stating that the de-facto complainant is a married women, aged about 31 years and taking advantage of her poverty, the accused had forcible intercourse with her on 14.05.2015.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate-I, Namakkal, Namakkal District, and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.
