The petitioner, who was arrested and remanded to judicial custody on 17.06.2025, for the offence punishable under Section 405, 420 of Indian Penal Code, 1806 & 4(1), 76(1) of the Chit Fund Act, 1982 in Crime No.03 of 2025 on 1/4
the file of the respondent, seeks bail.
2. The case of the prosecution is that the Accused-1 to Accused-6 who were running a chit fund company had collected the sum of Rs.3,00,00,000/-from more than 120 people promised the return of 15% on every 6 months but had not discharged their promise. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 17.06.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that the petitioner was arrested on 11.07.2025. He also submitted that the investigation is at the crucial stage if the petitioner is granted bail at this stage, there is possibility of tampering the witnesses and hampering the investigation. Hence he raised strong objection for granting bail.
5. Heard both sides and perused the materials available on record.
6. On perusal of the materials available, it is seen that the Petitioner 2/4
along with his family members had conducted an unregistered chit with 120 subscribers. They collected the money of Rs.3 crores 56 lakhs from those subscribers. After collecting the subscription money, the Accused were absconded. With very great difficulty, Accused 1 to 3 and 7 had been arrested on 17.06.2025. Other Accused are still absconding. Now, those 120 subscribers are in streets. The petitioners were active in running the unregistered chit.

Considering the over tact levelled against this petitioner and the gravity of the offence and the stage of investigation, a huge sum of amount is involved in this case, and for the custodial interrogation, the petitioner is needed. Hence, this Court is not inclined to grant the relief sought for. Accordingly, the Criminal Original Petition is dismissed.
